Hereinafter referred to as the “Seller”
And:
Any natural or legal person making a purchase via the website www.enigmesenseine.fr, Hereinafter referred to as the “Buyer”
Article 1. Purpose
These General Terms and Conditions of Sale (GTCS) define the rights and obligations of the parties in the context of the online sale of products offered by the Seller on the website www.enigmesenseine.fr.
Any order implies unconditional acceptance of these GTCS.
The Seller reserves the right to modify the GTCS at any time. The applicable GTCS are those in force on the date of the order.
Article 2. Products
The products offered are those listed on the website, subject to availability.
Each product is described as accurately as possible. Photographs are non-binding.
Article 3. Prices
Prices are indicated in euros, all taxes included (TTC).
As the Seller benefits from a VAT exemption, VAT is not applicable (Article 293 B of the French General Tax Code).
Delivery costs are indicated before the order is validated.
The Seller reserves the right to modify prices at any time, without retroactive effect.
Article 4. Orders
The Buyer selects the products, validates their cart, and proceeds to payment.
Order validation constitutes acceptance of the prices and products.
A confirmation email is sent after the order is validated.
Article 5. Payment
Payment is due immediately upon ordering.
Payments are made by credit card via a secure payment solution.
Article 6. Delivery
Products are delivered to the address indicated at the time of the order.
The delivery time is indicated when the order is placed and may not exceed 30 days.
In the event of a delay, the Buyer may request cancellation of the sale and a refund.
The Seller remains responsible for the product until it is received by the Buyer.
Article 7. Right of Withdrawal
In accordance with the French Consumer Code, the Buyer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without justification.
To exercise this right, the Buyer must notify their decision by email to:

Products must be returned to the following address:

Return costs are borne by the Buyer.
The refund is issued within 14 days after receipt of the returned products.
Article 8. Legal Guarantees
The Seller is bound by the following legal guarantees:
- Legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code)
- Guarantee against hidden defects (Article 1641 of the French Civil Code)
The Buyer has a period of two years to take action under the conformity guarantee.
In case of a defective product, the Buyer may request repair, replacement, or refund.
These guarantees apply independently of any commercial guarantee.
Article 9. Liability
The Seller shall not be held liable for damages resulting from improper use of the purchased product.
Article 10. Personal Data
The data collected is necessary for processing orders.
It is retained for the duration necessary to manage the commercial relationship.
In accordance with the GDPR, the Buyer has the right to access, rectify, delete, and object to the processing of their data.

The Buyer may lodge a complaint with the CNIL.
Article 11. Mediation
In accordance with the provisions of the French Consumer Code, the Buyer may use a consumer mediator free of charge.
After a prior written request to the Seller, the consumer may refer the matter to a consumer mediator.

Article 12. Intellectual Property
All elements of the website (texts, images, creative products, etc.) are protected by intellectual property law and remain the exclusive property of the Seller.
Any reproduction or use is prohibited without prior authorization.
Article 13. Applicable Law
These GTCS are governed by French law.
In the event of a dispute, the Buyer may bring proceedings before one of the courts with territorial jurisdiction under the Code of Civil Procedure, or before the court of the place where they resided at the time the contract was concluded.
